Borrower Rights Under Indian Banking Law
Defaulting on an EMI due to genuine financial distress is a civil matter, not a criminal offense. Despite this legal reality, borrowers who fall behind on loan payments are often subjected to intimidating calls, threats of immediate police action, or public humiliation by third-party recovery agencies.
The Reserve Bank of India (RBI) has laid down stringent directives in the Master Direction – Fair Practices Code for Lenders that all scheduled commercial banks, NBFCs, and digital lending platforms are legally bound to follow.
5 Uncompromising RBI Rules Governing Recovery Agents
1. Strictly Regulated Calling Hours (8:00 AM to 7:00 PM Only)
Recovery agents and bank representatives are strictly prohibited from calling borrowers before 8:00 AM or after 7:00 PM.
- Receiving calls late at night or early in the morning is a direct regulatory violation.
2. Complete Privacy of Third Parties (No Calling Friends or Employers)
Under the RBI Guidelines on Digital Lending and Recovery:
- Agents cannot contact your employer, HR department, colleagues, friends, or relatives to disclose your debt or demand repayment.
- Accessing or scraping your mobile phone contact list by lending apps is strictly outlawed.
3. Absolute Prohibition of Abuse and Intimidation
Agents must not resort to:
- Verbal profanity, threats of violence, or physical intimidation.
- Threatening immediate police arrest (a bank cannot arrest a borrower for an unsecured loan default without a court order).
- Staging noisy demonstrations or publicly embarrassing borrowers outside their home or workplace.
4. Mandatory Identification and Authorisation
Whenever an agent visits or calls a borrower, they must:
- Disclose their identity and the recovery agency they represent.
- Provide a copy of the bank's Authorisation Letter and official identity badge upon request.
5. Grievance Redressal Right Before Legal Recourse
Banks must provide a formal grievance mechanism and cannot proceed with SARFAESI property actions without providing statutory notice periods (typically 60 days under Section 13(2)).
The Escalation Protocol: How to Stop Recovery Harassment
If an agent violates any of these guidelines, follow this 3-step escalation protocol:
- Document Everything: Record call audio, save WhatsApp/SMS transcripts, and note down the caller's phone number and timestamp.
- File a Formal Complaint with the Bank's Principal Nodal Officer (PNO): Write an email to the lending bank's PNO quoting the agent's behavior and the specific RBI circular violation. Banks are required to acknowledge and resolve within 30 days.
- Escalate to the RBI Banking Ombudsman (CMS Portal): If the bank fails to resolve your grievance within 30 days, file an online complaint at cms.rbi.org.in. The RBI Ombudsman has the authority to award compensation for harassment and penalize non-compliant lenders.
