A recovery agency is calling my mobile at 9:30 PM and threatening to contact my workplace HR and relatives for an overdue EMI. Are they legally allowed to do this under RBI rules?

No, recovery agents are strictly prohibited from doing this. Permissible Calling Hours: Recovery calls or personal visits can ONLY be conducted between 8:00 AM and 7:00 PM. Calls after 7:00 PM are a direct regulatory violation. 2. Privacy and Third-Party Contact: Agents are strictly prohibited from calling your employer, HR, friends, or family members to disclose your debt details or demand payment. 3. Harassment & Intimidation: Verbal abuse, threats of police action without court summons, public shaming, or intimidation constitute punishable offenses under IPC and RBI directives. What to do immediately: 1. Document the calls: Keep call logs, timestamps, and audio recordings. 2. File a formal complaint with the Principal Nodal Officer (PNO) of the lending institution. 3. If unresolved within 30 days, file an online complaint at the RBI CMS Portal (https://cms.rbi.org.in) under the RBI Integrated Ombudsman Scheme. Banks face severe penalties for errant recovery agents.
